Retreat at Hope Farm Lodging and Rental Booking Event Terms and Guidelines

THESE TERMS OF USE APPLY IF YOUR COUNTRY OF RESIDENCE OR ESTABLISHMENT IS OUTSIDE THE UNITED STATES PLEASE READ THIS TERMS OF USE AGREEMENT (THE “TERMS OF USE”) CAREFULLY. BY ACCESSING OR USING THIS WEBSITE OR ANY OTHER SERVICES OF CABIN HIDEAWAYS INC, (COLLECTIVELY, “RETREAT AT HOPE FARM” OR “WE”) THAT LINKS TO THIS TERMS OF USE (COLLECTIVELY, THE “WEBSITE”) IN ANY WAY, INCLUDING USING THE SERVICES AND RESOURCES AVAILABLE OR ENABLED VIA THE WEBSITE (EACH A “SERVICE” AND COLLECTIVELY, THE “SERVICES”) BY RETREAT AT HOPE FARM OR USERS OF THE SITE (“USERS”), CLICKING ON THE “I ACCEPT” BUTTON, COMPLETING THE REGISTRATION PROCESS, AND/OR BROWSING THE WEBSITE , YOU REPRESENT THAT (1) YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THE TERMS OF USE, (2) YOU ARE OF LEGAL AGE TO FORM A BINDING CONTRACT WITH RETREAT AT HOPE FARM, AND (3) YOU HAVE THE AUTHORITY TO ENTER INTO THE TERMS OF USE PERSONALLY OR ON BEHALF OF THE ENTITY YOU HAVE NAMED AS THE CUSTOMER, AND TO BIND THAT ENTITY TO THE TERMS OF USE. THE TERM “YOU” REFERS TO THE INDIVIDUAL OR LEGAL ENTITY, AS APPLICABLE, IDENTIFIED AS THE USER WHEN YOU REGISTERED ON THE WEBSITE. IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS OF USE, YOU MAY NOT ACCESS OR USE THIS WEBSITE OR THE SERVICES. PLEASE BE AWARE THAT SECTION 7 (ARBITRATION AGREEMENT) OF THIS AGREEMENT, BELOW, CONTAINS PROVISIONS GOVERNING HOW DISPUTES THAT YOU AND WE HAVE AGAINST EACH OTHER ARE RESOLVED, INCLUDING, WITHOUT LIMITATION, ANY DISPUTES THAT AROSE OR WERE ASSERTED PRIOR TO THE EFFECTIVE DATE OF THIS AGREEMENT. IN PARTICULAR, IT CONTAINS AN ARBITRATION AGREEMENT WHICH WILL, WITH LIMITED EXCEPTIONS, REQUIRE DISPUTES BETWEEN US TO BE SUBMITTED TO BINDING AND FINAL ARBITRATION. UNLESS YOU OPT OUT OF THE ARBITRATION AGREEMENT: (1) YOU WILL ONLY BE PERMITTED TO PURSUE DISPUTES OR CLAIMS AND SEEK RELIEF AGAINST US ON AN INDIVIDUAL BASIS, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING; AND (2) YOU ARE WAIVING YOUR RIGHT TO PURSUE DISPUTES OR CLAIMS AND SEEK RELIEF IN A COURT OF LAW AND TO HAVE A JURY TRIAL. PLEASE BE AWARE (COMPANY COMMUNICATIONS) OF THIS AGREEMENT, BELOW, CONTAINS YOUR OPT-IN CONSENT TO RECEIVE COMMUNICATIONS FROM US, INCLUDING VIA E-MAIL, TEXT MESSAGE, CALLS AND PUSH NOTIFICATION. You should print a copy of these Terms of Use or save them to your computer for future reference. Your use of, and participation in, certain Services may be subject to additional terms (“Supplemental Terms”) and such Supplemental Terms will either be listed in the Terms of Use or will be presented to you for your acceptance when you sign up to use the supplemental Service. If the Terms of Use are inconsistent with the Supplemental Terms, the Supplemental Terms shall control with respect to such Service. The Terms of Use and any applicable Supplemental Terms are referred to herein as the “Agreement.” PLEASE NOTE THAT THE AGREEMENT IS SUBJECT TO CHANGE BY RETREAT AT HOPE FARM IN ITS SOLE DISCRETION AT ANY TIME. When changes are made, Retreat at Hope Farm will make a new copy of the Terms of Use available at the Website and any new Supplemental Terms will be made available from within, or through, the affected Service on the Website. We will also update the “Last Updated” date at the top of the Terms of Use. Any changes to the Agreement will be effective immediately for new Users and will be effective thirty (30) days after posting notice of such changes for existing Users. Retreat at Hope Farm may require you to affirmatively consent to the updated Agreement in a specified manner before further use of the Website or the Services is permitted. If you do not agree to any change(s) after receiving a notice of such change(s), you shall stop using the Website and/or Services. Otherwise, your continued use of the Website and/or Services constitutes your acceptance of such change(s). PLEASE REGULARLY CHECK THE WEBSITE TO VIEW THE THEN-CURRENT TERMS. 1.1 OUR SERVICES. Services Overview. Our Services include the online networks and services that (a) connect individuals seeking campsite information, events, and reservations (“Campers”) with resources about camping, campsites, events, and camping vans (“Vehicle(s)”), and other land or property suitable for use in connection with camping (each, a “Property”); (b) allow individuals or entities that own or otherwise have the authority to make available to Retreat at Hope Farm to make their Property available to Campers through a posted advertisement for such Property on the Services (each, a “Listing”); and (b) allow Campers to make reservations for access to and use of Property in accordance with the terms provided by the Retreat at Hope Farm (each, a “Booking”). These Terms of Use apply to both Campers and Event goers and their use of the Services.

1.2 Booking.

When you book a Listing, you are agreeing to pay all charges for your booking including the Listing price, applicable fees like platforms service fee, offline fees, taxes, and any other items identified during checkout (collectively, “Total Price”) at the time of booking. If you choose to pay using a currency that differs from the currency set by the Host for their Listing, the price displayed to you is based on a currency conversion rate determined by us. You are also agreeing that Retreat at Hope Farm may charge the Payment Method (as defined in the Payment Terms) used to book the Listing in order to collect Damage Report (as defined in Section 7) amounts. When you receive the booking confirmation, a contract for Host Services (a “Reservation”) is formed directly between you and Retreat at Hope Farm. By making a Reservation you are agreeing to the terms of the contract. The terms of the contract include these Terms, all terms of the Reservation, including without limitation, the cancellation policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout that apply to the Reservation. It is your responsibility to read and understand these terms of the contract including these Terms and all terms of the Reservation including all rules, standards, policies, and requirements prior to booking a Listing.

1.3 Accommodation Reservations.

An Accommodation Reservation is a limited license to enter, occupy, and use the Accommodation. A reservation can be placed up to 1 year in advance. The Retreat at Hope Farm retains the right to re-enter the Accommodation during your stay, to the extent: (i) it is reasonably necessary, (ii) permitted by your contract , and (iii) permitted by applicable law. If you stay past checkout, the Retreat at Hope Farm has the right to make you leave in a manner permitted with applicable law, including by imposing reasonable overstay penalties. You may not exceed the maximum number of allowed Guests.

1.4 Reservation Deposit

Retreat at Hope Farm can charge a security deposit to cover minor damages to their rental property. The deposit is set to 100 percent of the nightly rate. The hold is lifted 14 days after checkout if no damage is reported • If the Retreat at Hope Farm submits a claim for damages, the guest will be charged within 72 hour up to 14 days Security deposit refund • If no damage occurs, the deposit will be refunded to the guest • Pre-authorized charges are returned automatically, while full charges might require a manual refund Additional protection Retreat at Hope Farm strongly recommend travel insurance which handles significant and rare damages. However, deposits shouldn’t be considered a replacement for insurance.

2. Cancellations, Reservation Issues, Refunds and Booking Modifications.

2.1 Cancellations, Reservation Issues, and Refunds.

In general, if you cancel a Reservation, the amount refunded to you is determined by the policies and determine what amount is refunded to you. If something outside your control forces you to cancel a Reservation, you may be eligible for a partial or full refund under our Major Disruptive Events Policy. If the Host cancels, or you experience a Reservation Issue (as defined in our Rebooking and Refund Policy), you may be eligible for rebooking assistance or a partial or full refund under the Rebooking and Refund Policy. You may appeal a decision by Retreat at Hope Farm by contacting our customer service.

Standard cancellation policies for shorter stays

Your standard cancellation policy applies to all reservations of 27 or fewer consecutive nights. You can choose one of the following standard cancellation policies: Strict To receive a full refund, guests must cancel within 48 hours of booking, and the cancellation must occur at least 14 days before check-in If they cancel 14 or more days before check-in but not within 48 hours of booking, you’ll be paid 50% for all nights If they cancel between 7 and 14 days before check-in, you’ll be paid 50% for all nights If they cancel after that, you’ll be paid 100% for all nights

Long-term cancellation policies for monthly stays

Your long-term cancellation policy applies to monthly stays, which are reservations of 28 or more consecutive nights. You can choose one of the following long-term cancellation policies: Strict To receive a full refund, guests must cancel within 48 hours of booking, and the cancellation must occur at least 28 days before check-in If a guest cancels after that, you’ll be paid 100% for the nights already spent, plus the next 30 nights from the reservation If fewer than 30 nights remain on the reservation when the guest cancels, you’ll be paid 100% for all of those remaining nights. What happens if a Retreat at Hope Farm cancels before check-in

If a Retreat at Hope Farm cancels a reservation prior to check-in, their guest is entitled to a full refund, and where appropriate, Retreat at Hope Farm will to help the guest find a similar place, depending on availability at comparable pricing. Retreat at Hope Farm will generally convert the guest’s original payment into a booking credit to facilitate immediate rebooking, but guests can always request a refund to their original payment method instead. If the booking credit is unused after 72 hours, the amount of the credit will be refunded to the guest’s original payment method.

What happens if another Reservation

Issue disrupts a stay Guests must report Reservation Issues within 24 hours after discovery. If we determine that a Reservation Issue has disrupted a guest’s stay we’ll give the guest a full or partial refund, or help the guest find a similar place, depending on availability at comparable pricing. Rebooking assistance or the amount refunded depends on several factors including the severity of the Reservation Issue, the impact on the guest, the portion of the stay affected, whether the guest vacates the accommodations, other mitigating factors, and the strength of evidence provided of the Reservation Issue. What Reservation Issues are covered The term “Reservation Issue” refers to these situations:

Retreat at Hope Farm cancels the reservation prior to check-in.

Retreat at Hope Farm fails to provide their guest access to the accommodations. Accommodations are not habitable at check-in, including but not limited to any of the following reasons: Not reasonably clean and sanitary. Contain safety or health hazards. Accommodations are significantly different than advertised, including but not limited to any of the following reasons: Inaccurate space type (e.g. entire place, private room, or shared room). Inaccurate type or number of rooms (e.g. bedrooms, bathrooms, and kitchens). Inaccurate location of the accommodations. The Listing fails to disclose that the Host, another person, or a pet will be present during the stay. Special amenity or feature advertised in the Listing is not present or does not function (e.g. pool, hot tub, major appliance, heating, and air conditioning systems).

How to request rebooking assistance or a refund

To request rebooking assistance or a refund, the guest who made the reservation must contact us within 72 hours after discovery of the Reservation Issue. Requests should be supported by relevant evidence such as photographs, videos, or confirmation of the conditions by the Host, which we will use to help determine whether a Reservation Issue has occurred.

Major Disruptive Events Policy Overview

In general, cancellations and refunds for Retreat at Hope Farm reservations are governed by the listing’s cancellation policy. In the rare circumstances that large-scale events prevent or legally prohibit completion of a reservation, the Major Disruptive Events Policy (the “Policy”) may apply. When this Policy applies, guests can cancel their reservation and receive a refund, travel credit, and/or other consideration regardless of the reservation’s cancellation policy, and Hosts can cancel without fees or other adverse consequences, although their listing’s calendar will be blocked for the dates of the canceled reservation. This Policy applies to reservations for both accommodations and Experiences, and is applicable to reservations that are ongoing or that have a check-in on or after the effective date, except as otherwise notified by Retreat at Hope Farm to users. The Major Disruptive Events Policy is not an insurance policy. What events are covered The following events are covered under this Policy if they impact your reservation location, occur after the time of booking, and prevent or legally prohibit completion of a future or ongoing reservation (referred to in this Policy as “Events”): Declared public health emergencies and epidemics. Government-declared epidemics, pandemics, and public health emergencies. This does not include diseases that are endemic (for example, the flu) or commonly associated with an area (for example, malaria in Thailand). COVID-19 is not covered under this Major Disruptive Events Policy. Government travel restrictions. Mandatory travel restrictions imposed by a governmental agency, such as an evacuation order. This does not include non-binding travel advisories and similar government guidance. Military actions and other hostilities. Acts of war, hostilities, invasions, civil war, terrorism, explosions, bombings, rebellions, riots, and insurrection. Large-scale outages of essential utilities. Prolonged outages of essential utilities, such as heat, water, and electricity, impacting the vast majority of homes in a given location. Natural disasters. Natural disasters and other severe weather events. Weather or natural conditions that are common enough to be foreseeable in a given location—for example, hurricanes occurring during hurricane season in Florida—are covered only when they result in another Event covered by this Policy that prevents completion of the reservation, such as a mandatory evacuation order or large-scale outage of essential utilities. What happens if a reservation is impacted by a covered Event When a large-scale event occurs, we assess the situation to determine whether the Major Disruptive Events Policy applies. If it does, we activate the Policy for the impacted area and timeframe where we anticipate that the Event will prevent or legally prohibit completion of reservations. Reservations outside of the defined area and timeframe may not be eligible. We continuously monitor these situations and adjust coverage as needed to reflect changing conditions. What is not covered

We understand that other circumstances outside of your control may disrupt your plans. In any situations not listed above, your reservation remains subject to the Host’s cancellation policy for the listing. Examples of common events not covered by this policy include: Events that impact a guest or their ability to travel, but not the reservation location Unexpected injury or illness Government obligations like jury duty or court appearances Non-binding travel advisories or other government guidance that fall short of a travel ban or prohibition Cancellation or rescheduling of an event for which the reservation was made Transportation disruptions unrelated to a covered Event, such as airline insolvency, transportation strikes, and road closures due to maintenance For reservations not covered by this Policy, we encourage guests and Hosts to find a mutually acceptable arrangement, such as a full or partial refund or an alteration of the booking dates. Note that any refunds outside of the reservation’s cancellation policy are at the Host’s discretion. Retreat at Hope Farm does not take part in or guarantee such refunds. 2.2 Booking Modifications. Guests are responsible for any booking modifications they agree to make via the Platform or direct customer service to make on their behalf (“Booking Modifications”), and agree to pay any additional amounts, fees, or taxes associated with any Booking Modification. Namely, If you need to rebook otherwise, see the cancellation dates and at the time of rebooking that credit can be rebooked. If there is a difference, its paid at that time. No Refund will be given on a rebooked with credit used on reservation. The rebook reservation will be held for 72 hours as pending then will be canceled at that time and no refund given. 3. Your Responsibilities and Assumption of Risk. 3.1 Your Responsibilities. You are responsible and liable for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to any Accommodation, all areas and facilities where the Accommodation is located that the Host and Guest are legally entitled to use in connection with the Accommodation (“Common Areas”), or any Experience or other Host Service. For example, this means: (i) you are responsible for leaving an Accommodation (and related personal property) or Common Areas in the condition it was in when you arrived, (ii) you are responsible for paying all reasonable Damage Request amounts, and (iii) you must act with integrity, treat others with respect, and comply with applicable laws at all times. If you book a Service on behalf of additional guests, you are required to ensure that every additional guest meets any requirements set by the Host, and is made aware of and agrees to these Terms and any terms and conditions, rules and restrictions set by the Host. If you are booking for an additional guest who is a minor or if you bring a minor to a Host Service, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor. You are not responsible for the acts and omissions of anyone who you have contracted with through Retreat at Hope Farm the provision of Host Services, and have invited or provided access to an Accommodation for the purpose of providing such Host Services. 3.2 Your Assumption of Risk. You acknowledge that many activities carry inherent risks and agree that, to the maximum extent permitted by applicable law, you assume the entire risk arising out of your access to and use of the Platform and any Content, including your stay at any Accommodation, participation in any Experience, use of any other Host Service, or any other interaction you have with other Members whether in person or online. This means it is your responsibility to investigate a Host Service to determine whether it is suitable for you. For example, Host Services may carry risk of illness, bodily injury, disability, or death, and you freely and willfully assume those risks by choosing to participate in those Host Services. 4. Resolving Complaints and Damage Reports. If Retreat at Hope Farm provides valid evidence that you, your guest(s), or your pet(s) have: (i) damaged the complaining Member’s, or the Accommodation owner’s (where the Accommodation owner is not also the Host), real or personal property, or real or personal property the complaining Member is responsible for, or has an economic interest in; or (ii) caused loss of booking income for bookings via the Platform or other consequential damages which result directly from the damage caused under (i) above; or (iii) otherwise caused the complaining Member to incur cleaning costs in excess of the Member’s cleaning fee (each of (i), (ii), and (iii) being a (“Damage Report”), the complaining Member can notify Retreat at Hope Farm and/or seek compensation. You will be notified of the Damage Report and given an opportunity to respond. If you agree to pay, or if the Damage Report is escalated to Retreat at Hope Farm and Retreat determines in its sole discretion that the Damage Report is valid and you are responsible for the Damage Report, Retreat at Hope Farm can collect the amount of the Damage Report from you. You agree that Retreat at Hope Farm may seek to recover from you under any insurance policies you maintain and that Retreat at Hope Farm may also pursue against you any remedies it may have available under applicable law, including referral of the matter to a collections agency, and/or pursuit of available causes of action and/or claims against you. You agree to cooperate in good faith, provide any information Retreat at Hope Farm requests, execute documents, and take further reasonable action, in connection with Damage Reports, Member complaints, claims under insurance policies, or other claims related to your provision or use of Host Services. Start a reimbursement request File for reimbursement for damage, missing items, or unexpected cleaning. What’s covered Host damage protection covers you for: • Damage to your home, furnishings, valuables, or belongings caused by guests (or their invitees) • Damage to parked cars, boats, or other vehicles caused by guests (or their invitees) • Extra cleaning costs required to remove stains left by guests (or their invitees) or pet accidents, smoke odor removal, or when required due to additional unapproved guests • Income lost if you need to cancel confirmed Airbnb bookings due to damage caused by a guest (or their invitees) • Extra cleaning services in certain cases, like removing stains left by guests (or their invitees) or pet accidents and smoke odor removal. When you offer an emergency place to stay through the website, you’re still covered under Host damage protection. Host damage protection doesn’t cover: • Damage from normal wear and tear • Loss of currency • Loss due to acts of nature (ex: earthquakes and hurricanes) • Injury or property damage to guests or others (those may be covered by Host liability insurance) • Cleaning associated with normal check-out tasks (ex: laundry, dishes, or trash removal) • Other limitations apply The reimbursement process 1. Here’s how we are reimbursed a reimbursement request is made to guest. 2. Your guest will have 24 hours to respond to the request. If they don’t respond, pay partially, or decline payment, we will submit a reimbursement request under Host damage protection. How Host damage protection works with cleaning and pet fees Damage reimbursements without a security deposit If a guest, someone they invite, or a pet causes damage during a stay, the Host can request reimbursement. If its determined that the guest was responsible, the guest’s payment method may be charged. If you choose to include cleaning fees or a pet fee, please keep in mind that they are meant to cover expected costs. Host damage protection, on the other hand, covers unexpected costs related to additional cleaning in certain situations or pet damage—for instance, removing smoke odor or replacing your sofa because a dog chewed it up. 5. Retreat at Hope Farm’s Role. We may record, review, monitor, disable access to, remove, or edit text or in-app messages, phone recordings, or other Content to: (i) operate, secure and improve the Platform (including for fraud prevention, risk assessment, investigation and customer support purposes); (ii) ensure Members’ compliance with these Terms; (iii) comply with applicable law or the order or requirement of a court, law enforcement or other administrative agency or governmental body; (iv) address Content that we determine is harmful or objectionable; (v) take actions set out in these Terms; and (vi) maintain and enforce any quality or eligibility criteria.) and Standards , including decisions about whether and how to apply them to a particular situation, at its sole discretion. Members agree to cooperate with and assist Retreat at Hope Farm (or its affiliates) in good faith, and to provide us with such information and take such actions as may be reasonably requested by us with respect to any investigation undertaken by us regarding the use or abuse of the Platform. 6. Member Accounts. You must register an account to access and use many features of the Platform. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older. You represent and warrant that you are not a person or entity barred from using the Platform under the laws of the United States, your place of residence, or any other applicable jurisdiction. You must provide accurate, current, and complete information during registration and keep your account information up-to-date. You may not transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You are responsible and liable for activities conducted through your account and must immediately notify Retreat at Hope Farm if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalent 7. Arbitration Interpretation and enforcement of this Arbitration Agreement and any arbitration proceedings. If for whatever reason the FAA is inapplicable, the state law governing arbitration agreements in the state in which you reside shall apply. To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to CABIN HIDEAWAYS INC, 6068 Bethlehem Road, Springfield, TN 37172. Your letter must include (1) the name, telephone number, mailing address, and e‐mail address of the party seeking arbitration and the Account username, if any, as well as the email address associated with the Account; (2) a statement of the legal claims being asserted and the factual bases of those claims; (3) a description of the remedy sought and an accurate, good‐faith calculation of the amount in controversy in United States Dollars; (4) the party’s portion of the applicable filing fee. The arbitration will be conducted by JAMS, an established alternative dispute resolution provider. Disputes involving claims and counterclaims under $250,000, not inclusive of attorneys’ fees and interest, shall be subject to JAMS’s most current version of the Streamlined Arbitration Rules and procedures available at http://www.jamsadr.com/rules-streamlined-arbitration/. All other claims shall be subject to JAMS’s most current version of the Comprehensive Arbitration Rules and Procedures, available at http://www.jamsadr.com/rules-comprehensive-arbitration/. JAMS’s rules are also available at www.jamsadr.com or by calling JAMS at 800-352-5267. If JAMS is not available to arbitrate, the parties will select an alternative arbitral forum. If the arbitrator finds that you can’t afford to pay JAMS’s filing, administrative, hearing, and/or other fees and can’t obtain a waiver from JAMS, Retreat at Hope Farm will pay them for you. In addition, Retreat at Hope Farm will reimburse all such JAMS’s filing, administrative, hearing and/or other fees for claims, such amounts totalling less than $1,000, unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you reside, or at another mutually agreed location. Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Authority of arbitrator. The arbitrator shall have exclusive authority to (i) determine the scope and enforceability of this Arbitration Agreement and (ii) resolve any dispute related to the interpretation, applicability, enforceability or formation of this Arbitration Agreement including, but not limited to, any claim that all or any part of this Arbitration Agreement is void or voidable. The exceptions to the preceding sentence are (1) all disputes arising out of or relating to the class action waiver, including any claim that all or part of the class action waiver is unenforceable, illegal, void or voidable, or such class action waiver has been breached, shall be decided by a court of competent jurisdiction and not by an arbitrator; (2) all disputes arising out of or relating to the payment of arbitration fees shall be decided only by a court of competent jurisdiction and not by an arbitrator; and (3) all disputes arising out of or relating to whether either party has satisfied any condition precedent to arbitration shall be decided only by a court of competent jurisdiction and not by an arbitrator. The arbitration will decide the rights and liabilities, if any, of you and Retreat at Hope Farm. The arbitrator shall have the authority to grant motions dispositive of all or part of any claim. The arbitrator shall have the authority to award monetary damages and to grant any non-monetary remedy or relief available to an individual under applicable law, the arbitral forum’s rules, and this Agreement (including the Arbitration Agreement). The arbitrator shall issue a written award and statement of decision describing the essential findings and conclusions on which the award is based, including the calculation of any damages awarded. The arbitrator has the same authority to award relief on an individual basis that a judge in a court of law would have. The award of the arbitrator is final and binding upon you and us. Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Waiver of jury trial. YOU AND RETREAT AT HOPE FARM HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. There is no judge or jury in arbitration, and court review of an arbitration award is subject to very limited review. This clause shall not preclude parties from seeking provision remedies in aid of arbitration from a court of appropriate jurisdiction. Waiver of class or other non-individualized relief. ALL CLAIMS AND DISPUTES WITHIN THE SCOPE OF THIS ARBITRATION AGREEMENT MUST BE ARBITRATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS OR COLLECTIVE BASIS, ONLY INDIVIDUAL RELIEF IS AVAILABLE, AND CLAIMS OF MORE THAN ONE CUSTOMER OR USER CAN’T BE ARBITRATED OR CONSOLIDATED WITH THOSE OF ANY OTHER CUSTOMER OR USER. If a decision is issued stating that applicable law precludes enforcement of any of this subsection’s limitations as to a given claim for relief, then the claim must be severed from the arbitration and brought into the federal or state court located in San Francisco, California. All other claims shall be arbitrated. 30-day right to opt out. You have the right to opt out of the provisions of these Terms that mandate arbitration by sending written notice of your decision to opt out to: CABIN HIDEAWAYS INC, 6068 Bethlehem Road, Springfield, TN 37172, within 30 days after first becoming subject to a version of these Terms containing an arbitration provision. Your notice must include your name and address, your Retreat at Hope Farm username (if any), the email address you used to set up your Account (if you have one), and an unequivocal statement that you want to opt out of this Arbitration Agreement. If you opt out of arbitration, all other parts of these Terms will continue to apply to you. Opting out of arbitration has no effect on any other arbitration agreements that you may currently have, or may enter into in the future, with us. Severability. Except as provided in Section 16.2(h) (Waiver of Class or Other Non-Individualized Relief), if any part or parts of this Arbitration Agreement are found under the law to be invalid or unenforceable, then such specific part or parts shall be of no force and effect and shall be severed and the remainder of the Arbitration Agreement shall continue in full force and effect. Survival of Arbitration Agreement. This Arbitration Agreement will survive the termination of your relationship with Retreat at Hope Farm. Material Changes. Notwithstanding any provision in this Agreement to the contrary, we agree that if Retreat at Hope Farm makes any future material change to this Arbitration Agreement, you may reject that change within thirty (30) days of such change becoming effective by writing Retreat at Hope Farm at the following address: CABIN HIDEAWAYS INC, 6068 Bethlehem Road, Springfield, TN 37172
